1. Introduction and Acceptance of Terms

Welcome to BetterStep ("we," "our," "us," or "Company"). These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the BetterStep mobile application ("App," "Service").

By downloading, accessing, or using BetterStep, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our App.

2. About BetterStep

BetterStep is a wellness coaching mobile application designed to support individuals in addiction recovery as a post-rehabilitation companion. We provide:

  • Cognitive Behavioral Therapy (CBT) exercises
  • Names: Used to personalize your experience and identify your account
  • Wellness tracking (steps, heart rate, sleep, exercise)
  • Recovery progress monitoring
  • Personalized coaching and reminders
  • Journaling features
  • Evidence-based techniques and resources

BetterStep is a wellness and self-help tool, NOT a medical service. We do not provide medical advice, diagnosis, treatment, or therapy. We do not employ healthcare professionals or provide clinical consulting services. BetterStep is not a substitute for professional medical care, therapy, counseling, or emergency services.
3. Eligibility and Age Requirement

You must be at least 18 years of age to use BetterStep. By using this App, you represent and warrant that you are 18 years of age or older.

If you are under 18 years of age, you are not permitted to use this App under any circumstances.

Account Registration

To access certain features of BetterStep, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are solely responsible for your account and any activities conducted through it.

4. Subscription Plans and Payment Terms

BetterStep operates on a freemium model:

Premium Tier
  • Full access to all features
  • Advanced CBT exercises and coaching
  • Enhanced tracking and analytics
  • Personalized recommendations

Current Status

As of the date of these Terms, BetterStep is currently offering only the Free Tier. Premium features will be introduced in the future with advance notice to users.

Future Payment Terms (When Premium is Available)

When Premium subscriptions become available:

  • Billing: You will be charged the subscription fee at the beginning of each billing cycle (monthly or annual, as selected)
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
  • Payment Methods: We accept payment methods as displayed in the App
  • Price Changes: We reserve the right to change subscription prices with 30 days advance notice
  • Refunds: Refund policies will be clearly stated when Premium subscriptions launch
  • Free Trials: If we offer free trials, you may be charged automatically after the trial ends unless you cancelo Be Determined (TBD)
Cancellation

You may cancel your Premium subscription at any time through your account settings or by contacting us at info@betterstep.io. Cancellation will take effect at the end of your current billing period.

5. User Content and Journaling
Your Content

BetterStep allows you to create and store content, including:

  • Journal entries
  • Personal notes
  • Progress tracking data
  • Exercise responses
  • Goals and reflections

You retain all ownership rights to the content you create ("User Content").

License to Use Your Content

By creating User Content in BetterStep, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, and analyze your User Content solely for the following purposes:

  1. Service Delivery: To provide, maintain, and improve BetterStep's features and functionality
  2. AI Improvement: To train, develop, and enhance our artificial intelligence and machine learning algorithms
  3. Analytics: To understand usage patterns and improve our services
  4. Aggregated Insights: To create anonymized, aggregated data for research and development
Important Protections
  • We will de-identify and anonymize your User Content when used for AI training and improvement
  • We will NOT share your identifiable User Content with third parties for their commercial purposes
  • We will NOT publish your personal journal entries or recovery information publicly
  • All use of your User Content complies with our Privacy Policy
User Content Standards

You agree that your User Content will not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Contain malicious code or viruses
  • Harass, threaten, or harm others
  • Contain false or misleading information
  • Be used to impersonate others
Backup Responsibility

While we implement backup systems, you are responsible for maintaining your own backup of important User Content. We are not liable for any loss or corruption of User Content.

6. Acceptable Use Policy
Permitted Uses

You may use BetterStep solely for personal, non-commercial purposes to support your wellness and recovery journey.

Prohibited Activities

You agree NOT to:

  1. Violate Laws: Use the App in any way that violates applicable laws or regulations
  2. Unauthorized Access: Attempt to gain unauthorized access to any part of the App, other users' accounts, or our systems
  3. Reverse Engineering: Decompile, disassemble, reverse engineer, or attempt to derive source code from the App
  4. Data Mining: Use automated systems (bots, scrapers) to access or collect data from the App
  5. Interference: Interfere with or disrupt the App's functionality or servers
  6. Harmful Content: Upload viruses, malware, or any harmful code
  7. Account Sharing: Share your account credentials with others
  8. Commercial Use: Use the App for commercial purposes without our written permission
  9. Impersonation: Impersonate any person or entity
  10. False Information: Provide false or misleading information
  11. Harassment: Harass, abuse, or harm other users (if community features exist)
Consequences of Violations

Violation of these Terms may result in:

  • Warning or suspension of your account
  • Permanent termination of your account
  • Legal action if applicable
  • Reporting to law enforcement authorities
7. Intellectual Property Rights
Our Intellectual Property

All content, features, and functionality of BetterStep, including but not limited to:

  • Text, graphics, logos, images
  • Software code and architecture
  • CBT exercises and therapeutic content
  • Designs, interfaces, and layouts
  • Trademarks and service marks

are owned by BetterStep or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and use the App on your personal device
  • Access and use the App for its intended purpose

This license does not include any right to:

  • Resell or make commercial use of the App
  • Modify, copy, or create derivative works
  • Download or extract portions of the App
  • Use the App in ways not expressly authorized
Trademarks

"BetterStep" and our logo are trademarks of BetterStep. You may not use these marks without our prior written permission.

8. Medical Disclaimer and Limitation of Liability

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Given the sensitive nature of addiction recovery and health data, we apply enhanced security measures:

BETTERSTEP IS NOT A MEDICAL SERVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

  • No Medical Advice: The App provides wellness information, not medical advice, diagnosis, or treatment
  • No Healthcare Professionals: We do not employ doctors, therapists, counselors, or other licensed healthcare providers
  • Not for Emergencies: Do not use BetterStep for medical emergencies or crises
  • Supplement Only: BetterStep is designed to supplement, not replace, professional medical care
No Doctor-Patient Relationship

No doctor-patient, therapist-client, or professional healthcare relationship is created by your use of BetterStep.

Consult Healthcare Professionals

You should always:

  • Consult with qualified healthcare professionals regarding your health and recovery
  • Seek professional help for medical, psychological, or substance use concerns
  • Continue any prescribed treatment plans
  • Not discontinue medications or treatment based on App content
Emergency Situations

BetterStep is a support tool and cannot prevent relapse or provide crisis intervention.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, BetterStep disclaims all warranties, express or implied, including but not limited to:

  • Merchantability: We do not warrant that the App is suitable for your particular purpose
  • Fitness for a Particular Purpose: We do not guarantee the App will meet your specific needs
  • Non-Infringement: We do not warrant that the App does not infringe third-party rights
  • Accuracy: We do not guarantee the accuracy, completeness, or reliability of any content
  • Uninterrupted Service: We do not warrant that the App will be available at all times without interruption
  • Error-Free: We do not guarantee that the App will be free from bugs, errors, or defects
  • Security: We do not warrant that the App is completely secure from unauthorized access
No Guarantee of Results

We make no representations or warranties regarding:

  • The effectiveness of the App in supporting recovery
  • Any specific outcomes or results from using the App
  • The success of your recovery journey

Your recovery depends on many factors beyond the App's control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Exclusion of Damages

BetterStep, its officers, directors, employees, agents, and affiliates shall NOT be liable for:

  • Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
  • Lost Profits: Loss of profits, revenue, data, or business opportunities
  • Personal Injury: Any physical or psychological harm, including relapse, injury, or death
  • Medical Consequences: Any medical or health consequences resulting from App use
  • Data Loss: Loss or corruption of User Content or data
  • Service Interruptions: Damages arising from App unavailability or interruptions
  • Third-Party Actions: Actions or content of third parties
  • Reliance on Content: Any reliance on information provided through the App
Cap on Liability

In no event shall BetterStep's total aggregate liability exceed the amount you paid to BetterStep in the twelve (12) months preceding the event giving rise to liability, or $100 USD, whichever is less.

For users on the Free Tier who have paid nothing, our liability is limited to $0.

Basis of the Bargain

You acknowledge that these limitations of liability are a fundamental element of the agreement between you and BetterStep. The App would not be provided without these limitations.

11. Indemnification

You agree to defend, indemnify, and hold harmless BetterStep and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from:

  1. Your use or misuse of the App
  2. Your violation of these Terms
  3. Your violation of any third-party rights
  4. Your User Content
  5. Any harm or damage caused to any third party through your use of the App

This indemnification obligation survives termination of these Terms.

12. Third-Party Services and Links
Third-Party Services

BetterStep integrates with third-party services, including:

  • Firebase (Google)
  • Google Analytics
  • Social media platforms (when you connect them)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

The App may contain links to third-party websites or resources. We provide these for your convenience only and:

  • Do not endorse linked websites or their content
  • Are not responsible for the content, accuracy, or practices of linked sites
  • Are not liable for any harm or damages related to linked sites

You access third-party links at your own risk.

13. Account Termination and Suspension
Your Right to Terminate

You may terminate your account at any time by:

Upon termination:

  • Your access to the App will cease
  • Your User Content may be deleted according to our data retention policies
  • You can request deletion of your data as outlined in our Privacy Policy
Our Right to Terminate

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security concerns
  • Discontinuation of the App or Service
Effect of Termination

Upon termination by either party:

  • All licenses granted to you terminate immediately
  • You must cease all use of the App
  • You remain liable for any obligations incurred before termination
  • Sections of these Terms that by their nature should survive termination will survive
No Refunds

If your account is terminated for violation of these Terms, you are not entitled to any refund of subscription fees.

14. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using BetterStep, you consent to:

  • Our collection and use of your information as described in the Privacy Policy
  • The transfer of your data to servers that may be located outside your jurisdiction
  • Our use of your de-identified User Content to improve our AI and services

15. Changes to the App and Terms
Modifications to the App

We reserve the right to:

  • Modify, update, or discontinue any features of the App
  • Change the availability of the App or any features
  • Introduce new features or services
  • Remove or limit features at any time

We are not liable for any modifications, suspensions, or discontinuation of the App.

Changes to Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date at the top
  • We will notify you through the App, email, or other reasonable means
  • Continued use of the App after changes constitutes acceptance of the new Terms

16. Dispute Resolution and Governing Law
Governing Law

These Terms and your use of BetterStep are governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law principles.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the courts located in Tbilisi, Georgia. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Disputes

If you have any dispute with BetterStep, you agree to first contact us at info@betterstep.io to attempt to resolve the dispute informally before initiating any legal proceedings.

Limitation Period

Any claim arising out of or relating to these Terms or the App must be filed within one (1) year after the claim arose. After this period, such claims are permanently barred.

17. General Provisions
Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterStep regarding your use of the App and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms at any time without notice to you.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights. Only you and BetterStep may enforce these Terms.

Force Majeure

Any claim arising out of or relating to these Terms or the App must be filed within one (1) year after the claim arose. After this period, such claims are permanently barred.

Limitation Period

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or fuel crises.

Headings

Section headings in these Terms are for convenience only and do not affect their interpretation.

Interpretation

These Terms will not be construed more strictly against either party regardless of who drafted them.

Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
